1. Your General Obligations for Acceptable Use
1.1. Must Be Legal
Your website or any of our services must not be used to promote or distribute any content that is illegal under the laws of your country, the host country, or the laws of the UK, USA, or EU. The internet is global, and what is legal in one place may be illegal in another, which could expose you or us to legal action.
1.2. No Intellectual Property Infringement
You are fully responsible for ensuring that all materials on your site are created by you or that you have permission to use them. Content you publish must not infringe copyright, trademarks, or other intellectual property rights. We reserve the right to remove any infringing content without notice.
1.3. Intellectual Property Disputes
You are responsible for handling any disputes arising from your use of intellectual property rights. You also agree to indemnify us for any legal or other costs if a claim is made against us due to your use of these rights.
1.4. Abuse Investigation
We reserve the right to investigate any potential abuse of our servers, including auditing content, blocking or removing it, and suspending or terminating violating accounts without notice.
1.5. Prohibited Activities
- •Hacking, phishing, spamming, botnet creation or operation, port scanning, malware distribution.
- •Unauthorized access to data or systems.
- •Operating VPN or Proxy services without permission.
- •Any activity later stated in the policy as prohibited.
2. Acceptable Use of Resources
2.1. Resource Allocation
Resources are allocated according to your hosting plan and may only be used for hosting, email, and related services.
2.2. Preventing Excessive Usage
Resources must not be consumed in a way that negatively impacts server performance or disrupts other customers' services. We reserve the right to suspend, throttle, or terminate your account.
2.3. Usage Limits
Includes: number of mailboxes, mailbox capacity, database size, storage space, and data transfer.
3. Acceptable Use of Shared Hosting
3.1. Fair Usage Limits
- •Media size must not exceed 10 GB.
- •Email storage must not exceed 20 GB.
- •Database size must not exceed 10 GB.
- •Local backups should be minimized.
- •Software uploads must not exceed 1 GB; using a CDN is preferred.
- •On "unlimited" plans, each sub-account must not exceed 50 GB.
- •Service must not be used as external backup storage.
- •File sync services like NextCloud or OwnCloud are prohibited.
- •Software download sites must not be hosted.
3.2. Adult Content
Hosting adult content requires prior approval and is evaluated based on applicable laws.
3.3. Regulated Industries
We may request additional legal documentation when hosting sites in fields such as finance, pharmaceuticals, or lotteries.
3.4. Email (SMTP) Use
- •Reselling mailboxes is not allowed.
- •Must comply with storage and sending limits.
- •We may block or delay email delivery.
- •We are not liable for losses caused by blocking or delays.
3.5. File Visibility
All uploaded files must be accessible via the domain, except system files. We reserve the right to delete files that do not meet this requirement.
4. Acceptable Use of Email
4.1. Zero Tolerance Spam Policy
We prohibit sending unsolicited bulk email and will take immediate action against violating accounts.
4.2. Mandatory Conditions
- •Do not send unwanted, abusive, or illegal messages.
- •Include an unsubscribe link.
- •Do not email users who have opted out.
- •Do not use forged headers or unauthorized addresses.
- •Ensure no open relay is present.
- •Take full responsibility for your email reputation.
- •Do not violate laws such as CAN-SPAM or GDPR.
5. Reseller Accounts
5.1. Suspended Accounts
We reserve the right to delete suspended accounts after 60 days without keeping backups.
5.2. Customer Communication
Resellers are encouraged to contact their clients promptly to prevent data loss.
6. Notification and Resolution
6.1. In Case of Violation
Service may be suspended or terminated immediately with or without notice. We may give you a grace period to correct the situation.
6.2. Grace Period
If fair usage limits are exceeded, a 24-72 hour correction period may be granted, but we reserve the right to act immediately.
7. Indemnification
7.1. Waiver of Claims
You waive all claims and rights against Somion Web Services and its affiliates related to your use of the service.
7.2. Our Indemnity
You agree to indemnify us for any losses, expenses, or claims resulting from your misuse or breach of our agreements.
7.3. Confirmation and Participation
We may require written confirmation of your commitment to defend us if a legal claim is made. Failure to provide confirmation constitutes a breach.
7.4. Continuing Obligation
These obligations remain in effect even after cancellation or termination of our agreement.
